Entire Agreement and Purpose

The general terms and conditions of sale (hereinafter referred to as the “General Terms and Conditions”) set out below exclusively govern the contractual relationship between any non-professional user of the website www.bordai.com (hereinafter referred to as the “Buyer” or “You”) and the seller Bordai SARL, a company with share capital of €200, whose registered office is located at 26 quai d'Orléans, 75004 Paris, France, registered with the Paris Trade and Companies Register under number 92915283300018, with intra-community VAT number FR66929152833 (hereinafter referred to as “Bordai”).

These General Terms and Conditions are the only applicable terms and replace all others, except by prior, express, and written agreement. Bordai may occasionally amend certain provisions of the General Terms and Conditions, so it is necessary to reread them before each order on the website www.bordai.com (hereinafter referred to as the “Site”).

The General Terms and Conditions are accessible at all times on the Site and prevail, where applicable, over any other version or any contradictory document. Such modifications are binding from the time they are posted online and cannot be applied to contracts concluded previously. Each purchase on the Site is governed by the General Terms and Conditions applicable at the date of the order.

The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in connection with the online sale of goods offered by Bordai to the Buyer.

The Buyer declares that they have read these General Terms and Conditions and accepted them by checking the box provided for this purpose before proceeding with any online order. By checking this box, you agree to comply with the General Terms and Conditions as well as the terms of use contained therein.

Orders

The Buyer may place an order online from the online catalog using the order form provided.

The ordering process consists of three (3) successive steps. Once you have selected your products (size, color, quantity) and validated your cart, you must:

  • create an account or log in if you already have one;

  • accept the General Terms and Conditions by checking the box provided on the order summary page (entitled “summary”);

  • choose your payment method. Once your payment method is selected, you must proceed with payment of your order, which will formally and definitively establish the sales contract binding you to Bordai.

Any order constitutes acceptance of the prices and descriptions of the products available for sale.

In certain cases, such as non-payment, incorrect address, or other problems with the Buyer’s account, Bordai reserves the right to block the Buyer’s order until the issue is resolved.

In the event of unavailability of an ordered product, the Buyer will be informed by email. The cancellation of this product and its possible refund will then be carried out, with the remainder of the order remaining firm and binding.

Product Information

The products covered by these General Terms and Conditions are those listed on the website www.bordai.com and indicated as sold and shipped by Bordai. They are offered within the limits of available stock.

Bordai takes the utmost care in posting information relating to the essential characteristics of the products, including detailed descriptions and photographs illustrating the products.

However, if errors or omissions occur in this presentation, Bordai cannot be held liable.

The product photographs are not contractual.

Prices

Bordai reserves the right to modify its prices at any time but undertakes to apply the rates in force indicated at the time of the order, subject to availability at that date.

Prices are indicated in euros. They do not include shipping costs, which are invoiced in addition and indicated before order validation. Prices include VAT applicable on the date of the order, and any change in the applicable VAT rate will automatically be reflected in the online shop prices.

Payment of the full price must be made at the time of the order. Under no circumstances can amounts paid be considered as deposits or down payments.

Payment and Electronic Signature

The price is payable in full on the day of the order by the Buyer.

Bordai offers the following payment methods:

  • Payment by credit card (Visa, Mastercard)

  • Payment by PayPal

Bordai reserves the right to suspend order processing and delivery in case of refusal of authorization of payment by credit card from officially accredited organizations or in case of non-payment.

Entering your credit card number online and final validation of the order will serve as proof of your agreement in accordance with the provisions of the law of March 13, 2000 and will constitute:

  • enforceability of the amounts due under the purchase order;

  • signature and express acceptance of all operations carried out.

In the event of fraudulent use of a credit card, the Buyer is invited, as soon as such use is discovered, to send an email to hello@bordai.com.

The bank server is secured through SSL (secure socket layer) encryption to protect, as effectively as possible, all data related to payment methods.

Right of Withdrawal and Returns

In accordance with applicable law, the Buyer has fourteen (14) days from the date of receipt to exercise their right of withdrawal with Bordai, without having to provide reasons or pay penalties, provided that the product(s) are returned in their original condition within fourteen (14) days following notification of the decision to withdraw.

The product(s) must be returned in their original packaging and condition to the following address:

Warranty

The products sold are covered by a commercial warranty aimed at ensuring their conformity and guaranteeing either a refund of the purchase price, replacement, or repair of the goods.

This warranty does not cover defects caused by abnormal or improper use or resulting from causes unrelated to the intrinsic qualities of the products.

Intellectual Property

All content on the Bordai website (illustrations, texts, labels, trademarks, images, videos) is the property of Bordai. Any partial or total reproduction of the content, by any means and on any medium whatsoever, is subject to prior and express authorization from Bordai.

Privacy and Personal Data

Bordai is committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR).

Force Majeure

Any circumstances beyond the control of the parties preventing the performance of their obligations under normal conditions shall be considered grounds for exemption from the parties’ obligations and shall result in their suspension.

Governing Law

These General Terms and Conditions are subject to French law. In case of dispute or complaint, the Buyer shall first contact Bordai to seek an amicable solution. Failing that, the Buyer may initiate proceedings before the competent jurisdiction.
